Terms & Conditions
Effective date: October 14, 2026 · Please review before purchasing.
1. Provider and services
These terms govern lead follow-up and recovery workflow implementation services offered under the FlowHVAC trade name by an individual operator (“FlowHVAC,” “we,” or “Provider”). FlowHVAC is not currently represented as a registered LLC or corporation. The service is intended to help HVAC businesses organize lead follow-up and related workflows. The exact deliverables for each customer must be confirmed in a written scope before implementation begins.
2. Price, recurring retainer, and payment
The standard price is a $5,000 USD one-time implementation fee plus a recurring $700 USD monthly retainer for ongoing support and service as defined in the customer's written scope. The implementation fee and monthly retainer are separate charges. The monthly retainer is recurring and continues each month until cancelled in accordance with the cancellation terms agreed in writing and applicable law. Before recurring billing begins, FlowHVAC must disclose the billing start date, payment method, billing interval, and cancellation process, and the customer must expressly authorize the recurring payment through a subscription checkout or other documented authorization. Do not treat a one-time Stripe payment as authorization for recurring billing. If the current checkout only collects the $5,000 implementation fee, the $700 monthly retainer must be accepted and set up separately before it is charged. Third-party software, messaging, telephony, advertising, and usage fees are excluded unless expressly included in writing.
3. Scope of work
Subject to a written scope and compatibility confirmation, implementation may include:
- Review of the customer's existing lead intake and follow-up process.
- Configuration of agreed lead follow-up workflows using compatible software.
- Agreed lead-status tracking, notifications, and handoff steps.
- Testing of agreed functionality using sample or authorized test data.
- Handoff instructions and a walkthrough of the delivered workflow.
The specific platforms, integrations, channels, number of workflows, and deliverables must be documented and accepted before work starts. Unlisted features, custom development, migrations, additional integrations, ongoing campaign management, and unlimited revisions are excluded unless separately agreed.
4. Compatibility and start of work
Work begins after payment is confirmed, onboarding information and necessary access are provided, and FlowHVAC confirms the written scope and compatibility. If the requested setup is not compatible or requires work outside the agreed scope, the parties will discuss an updated scope before proceeding with that work.
5. Estimated timeline
The estimated implementation period is 4–6 weeks after payment, completed onboarding, receipt of required access and information, and written scope confirmation. This is an estimate, not a guaranteed completion date. Customer delays, third-party outages, unavailable integrations, and scope changes may extend the timeline. FlowHVAC will communicate material delays and next steps.
6. Customer responsibilities
The customer must provide accurate information, authorized access, timely decisions, and any required approvals. The customer is responsible for obtaining appropriate consent to contact leads, complying with applicable marketing, privacy, and communications laws, and ensuring it has the right to provide data used in the system. Do not send passwords or sensitive credentials through ordinary forms or email; use secure access methods and least-privilege permissions.
7. Testing and acceptance
When the agreed implementation is ready for review, FlowHVAC will notify the customer. The customer should report reproducible issues within the agreed scope within 10 business days of handoff. FlowHVAC will make reasonable efforts to correct verified defects in the agreed configuration during the included support period. New features, changed requirements, and additional integrations are not defects and may require a separate quote.
8. Ongoing support and monthly retainer
The $700 USD monthly retainer covers only the ongoing support and services expressly listed in the customer's written scope. The written scope must specify included support, maintenance, monitoring, workflow adjustments, communication channel, service limits, and exclusions. Unless expressly listed, the retainer does not include new features, additional integrations, third-party fees, unlimited revisions, emergency response, or guaranteed response/resolution times. The billing start date, recurring payment authorization, billing interval, and cancellation process must be confirmed in writing before recurring billing begins. If a separate written scope does not define what the retainer covers, the parties must agree on that scope before the retainer is charged.
9. No performance guarantee
FlowHVAC provides workflow implementation services and does not guarantee a particular number of recovered leads, appointments, sales, conversion rates, revenue, or return on investment. Outcomes depend on lead quality, customer processes, software availability, and other factors outside FlowHVAC's control.
10. Third-party services
Workflows may rely on third-party software or services that have separate terms, pricing, limits, and availability. FlowHVAC is not responsible for third-party outages, changes, or fees. The customer remains responsible for its own accounts and approved usage charges.
11. Changes to scope
Changes to deliverables, platforms, integrations, or requirements must be approved in writing by both parties. Additional work may require additional fees and a revised timeline. No additional charge will be made without the customer's written approval.
12. Cancellation and refunds
See the separate Refund Policy, which forms part of these terms. Nothing in these terms excludes rights or remedies that cannot legally be excluded.
13. Liability and legal terms
To the extent permitted by applicable law, neither party will be liable for indirect or consequential losses arising from the services. Any limitation of liability must be interpreted subject to rights and liabilities that cannot legally be limited or excluded. The parties should obtain legal advice to complete governing-law, dispute-resolution, and any other mandatory terms for their circumstances.
